Terms of Service

It should be said that we have never had a challenge with a client that required us to refer back to this document. We are here to create beautiful works of art and work with the client to achieve a wonderful outcome. Our client reviews and Bride’s Choice Awards many years in a row are a testament to this mission.

That said, here are a few basic items that inform you of how we work and what you can expect should the unexpected happen.

A 25% deposit retainer must be paid at the time of booking each service, with the balance due prior to the event date. This initial retainer is made to secure the date for the Pacific Story Tellers LLC (umbrella company of Stephan Boeker Films and herein known as PST) services. It is the client’s guarantee that PST will have all the resources needed to deliver the ordered service in the client’s time slot. In the event of a postponement or cancellation of the wedding described above, PST reserves the right to retain all deposits paid.

PST offers this quality guarantee:

  1. our service is provided with enthusiasm and a smile;
  2. the film is of professional quality.

PST and client (bride/groom) mutually agree to the terms and conditions of this contract. A firm and binding agreement exists between PST and client only after this agreement has been properly executed and the deposit fee is paid prior to the event. This agreement supersedes and replaces any previous document, correspondence, conversation or other written and/or oral understanding pertaining to the events and details of your wedding videography / photography.

PST’s liability is limited to refund of money paid. In the unlikely event that a problem arises whether due to theft, lateness, no show, accident, neglect, human error, loss of materials, acts of God, power loss by utility companies, wireless interference, equipment or other failures and that PST is unable to provide any wedding photography or wedding video, refunds are limited to the amount paid. PST is not responsible for loss of photography, video, or audio quality due to restrictions at event locations or interference from guests or other persons. PST stands behind its productions, and will return all deposits if, for reasons beyond its control, it cannot videotape or photograph your wedding.

CLIENT IS RESPONSIBLE FOR CHECKING ALL MATERIALS RECEIVED FROM PST WITHIN 10 DAYS OF RECEIPT. If a file does not properly function on client’s playback device, client must notify PST within 10 days. PST Take will re-master client’s video. If client does not notify PST within 10 days of receipt, additional fees will apply to make any corrections or changes, if possible.

Any controversy or claim arising out of or relating to this agreement, or breach thereof, shall be settled by mediation, and judgment upon the award by the mediator(s) may be entered in any court having jurisdiction thereof. The parties wave trial by jury to the extent permitted by law, and expressly agree to mediation in any action, proceedings or counter claim brought by either party against the other or any other matter what so ever arising out of or in any way connected to this agreement.

Errors and Omissions are not the responsibility of PST. Your video will contain the exact names and spellings specified on this contract. It is the responsibility of the client to contact PST if there are any changes in dates, addresses, or phone numbers. An agenda should be provided to PST so that all main events are captured on video. If no agenda is provided, and an event is missed at either the ceremony or reception, PST is not responsible. Client should inform the DJ, photographer, and coordinators that a videographer will be present. PST is not responsible if the DJ or other event coordinator begins an event or activity prior to ensuring that the videographer is present and ready.

Mastering your video will take approx. 8 weeks to produce from the date of your event or from the date all necessary pictures/songs are received. Client will be notified when the videos are completed and ready for delivery. PST reserves the right of reproduction for display/marketing purposes only, including demo DVDs and website sample videos.

For weddings 6 hours or longer, we require a vendor meal for at least 2 people.

All that legalese said, it should be mentioned that we have never had any reason to point back to this policy statement because a client wasn’t happy. Our aim is to provide a solid service and product that makes our clients and their viewing audience happy.
